Terms of service

Last updated: 27 September 2026

These terms apply when an organisation subscribes to the Fun In Raising platform. They are a business-to-business agreement. By creating an organisation, or by signing an order form that refers to these terms, the organisation agrees to them.

1. The parties

"We" means [registered company name to be confirmed], a company registered in England and Wales with company number [company number to be confirmed]. "Customer" means the organisation that subscribes. "Users" means the people the Customer allows to use its organisation, such as staff, fundraisers and charity client viewers.

2. The service

We provide the Fun In Raising platform as an online service at the Customer's own address. We may improve and change features. We will not remove a major feature the Customer pays for without at least 60 days' notice. Features marked as in development or preview are provided as they are and may change.

3. Accounts and security

  • The Customer controls who has access and which role each User has.
  • Each User must have their own account. Accounts must not be shared.
  • The Customer must keep administrator accounts protected with two-step verification.
  • The Customer must tell us promptly about any suspected unauthorised access.

4. The Customer's responsibilities

The Customer is responsible for how it uses the service, and in particular for:

  • complying with the Code of Fundraising Practice, and any licence, exemption or site agreement that applies to its fundraising;
  • having a lawful basis for the personal data it puts into the service, including data about its staff and supporters;
  • telling its staff about any monitoring, such as location sharing during shifts, and carrying out any data protection impact assessment the law requires;
  • making employment decisions. The service gives information and suggestions. It never makes decisions about promotion, discipline or pay;
  • following our Acceptable Use Policy.

5. Fees and payment

  • Fees are set out on our pricing page or in an order form. An order form wins if the two differ.
  • Unless an order form says otherwise, fees are charged monthly in arrears for active fundraisers in that month.
  • Invoices are due within 30 days. Prices exclude VAT, which is added at the applicable rate.
  • We may change our prices with at least 60 days' written notice. The Customer may cancel before the change takes effect.
  • If an invoice is more than 30 days overdue, we may suspend the service after giving 14 days' written notice.

6. Trials and the demo organisation

Trials and the public demo organisation are free, provided as they are, and may be reset or ended at any time. Do not put real personal data into the demo organisation.

7. Customer data

The Customer owns the data it and its Users put into the service. We process it only to provide the service and as set out in our Data Processing Agreement, which forms part of these terms. We keep each Customer's data isolated from every other customer's.

The Customer can ask for a complete export of its data at any time, and we will provide it within 10 working days. When the subscription ends, we keep the data for 30 days so it can be exported, then delete it, except where the law requires us to keep it.

8. Intellectual property

We own the service, its software, and the academy content we provide. The Customer receives a non-exclusive, non-transferable right to use them during the subscription for its own fundraising operations. The Customer owns its own content, such as its campaign materials and scripts, and gives us the right to host and display it to provide the service.

9. Confidentiality

Each party keeps the other's confidential information private and uses it only for this agreement. This does not apply to information that is public, already known, independently developed, or that the law requires to be disclosed.

10. Availability and support

We aim to keep the service available at all times, apart from planned maintenance, which we try to do outside UK working hours. We provide support by email at [email protected] on UK working days. Enterprise customers may have a separate service level agreement.

11. Warranties

We will provide the service with reasonable skill and care. Apart from that, and to the extent the law allows, the service is provided without other warranties. In particular, AI suggestions, diagnoses and predictions are estimates to support human judgement and may be wrong.

12. Liability

  • Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.
  • Neither party is liable for loss of profits, revenue, goodwill or indirect or consequential loss.
  • Each party's total liability in any 12-month period is limited to the fees paid or payable by the Customer in that period.

13. Term and ending

  • Monthly subscriptions continue until either party ends them with notice before the end of a month.
  • Either party may end the agreement straight away if the other seriously breaches it and does not fix the breach within 30 days of written notice, or becomes insolvent.
  • Sections 7, 8, 9 and 12 continue after the agreement ends.

14. General

  • We may update these terms. We will give 30 days' notice of any change that materially reduces the Customer's rights.
  • Neither party may transfer this agreement without the other's consent, except as part of a sale of its business.
  • Neither party is liable for delays caused by events outside its reasonable control.
  • These terms are the whole agreement about the service, together with any order form and the Data Processing Agreement.
  • These terms are governed by the law of England and Wales, and its courts have exclusive jurisdiction.
